Selling digital templates to customers in the US — any VAT or tax issues?
I run a small business in London, and I have started selling digital templates online, including menu layouts, price lists, and social media templates that customers download straight after paying. Most of my buyers so far are in the UK, but I am now getting regular orders from customers in the United States, usually for about £15 to £40 per template. I sell through an online marketplace, which handles the payment, but I am not sure whether it also handles any tax on my behalf.
My main question is whether I need to worry about UK VAT on sales to US customers. I am not VAT-registered yet, because my total sales are still below the UK threshold, but I am getting closer to it. Do sales to customers outside the UK count towards that threshold in the same way, or are they treated differently? And if I do register for VAT later, would I charge VAT on US sales, or would they be outside the scope of UK VAT?
I am also unsure about US tax. I have heard about state sales tax for digital products, and I am worried that I might need to register or file returns in the US, even though I am based in the UK and have no office or staff there. Does selling through a marketplace change that, and does it matter whether the customer is a business or an individual? I do not want to ignore a requirement simply because it feels too complicated for a small seller.
Finally, how should I record these overseas sales for my UK tax return? Should I keep the customer's location, the platform fees, and any currency conversion details? And are there any common mistakes that small digital sellers make when they start selling abroad? Any practical steps for keeping this simple and compliant would be very welcome.
