Question

CIS for subcontractors — how does it actually work?

Hi, this one is actually on behalf of my partner, who is a self-employed bricklayer. I'm the one who handles his paperwork, and I'm trying to get my head around the Construction Industry Scheme. He works for a main contractor who takes 20% off his payments before paying him. A few questions: is that 20% a final tax, or does he get some back when he does his tax return? Does he need to register as a subcontractor with HMRC, and what's the difference between the 20% and 30% deductions I've seen mentioned? Any help explaining this in plain English would be amazing — thank you!

Good news first: the 20% isn't a final tax — it's an advance payment towards his tax and National Insurance, and it's set against his total bill when he files his Self Assessment return, so if too much was deducted he'll get a refund. He doesn't have to register as a subcontractor, but it's strongly in his interest: registered subcontractors have 20% deducted, while unregistered ones have 30% taken off. Registration is straightforward through HMRC and means less money held back each month. One more thing to know: the deduction applies to labour, not materials, so he should make sure his invoices split the two out clearly.
